Régimen orgánico y funcional del Tribunal de Cuentas como órgano de control externo del sector público provincial
La Ley Provincial 50 regula la organización y funcionamiento del Tribunal de Cuentas de la Provincia de Tierra del Fuego como órgano autónomo de control externo de la gestión económico-financiera del Estado, extendiendo su competencia a los tres poderes, entes descentralizados, municipalidades, comunas y sociedades con participación estatal . El legislador estructura un sistema de control integral que combina funciones preventivas y posteriores, incluyendo la fiscalización de actos administrativos que impliquen erogaciones, auditorías externas, examen y juicio de cuentas, y la determinación de responsabilidades civiles por daños al patrimonio público.
El articulado establece un régimen robusto de control con facultades para observar actos administrativos, suspender su ejecución y comunicar a la Legislatura, previendo incluso la posibilidad de insistencia por parte del órgano controlado bajo su exclusiva responsabilidad. Asimismo, regula procedimientos específicos como la rendición de cuentas obligatoria para agentes estatales y terceros, el juicio de cuentas y el juicio administrativo de responsabilidad, con facultades para iniciar acciones judiciales y ejecutar créditos mediante vía de apremio. La norma se vincula directamente con la Constitución Provincial, que fundamenta su autonomía, así como con el Código Civil y Comercial de la Nación en materia de prescripción, y el Código Procesal Civil y Comercial como norma supletoria.
En cuanto a modificaciones, las sucesivas leyes (134, 871, 495, 1333, entre otras) introducen mejoras en los mecanismos de control, fortalecen el carácter preventivo, ajustan plazos de prescripción y perfeccionan la estructura orgánica. Desde una perspectiva crítica, la ley configura un sistema de control sólido y técnicamente completo, aunque su eficacia depende de la independencia real del órgano y de la capacidad operativa para ejercer controles oportunos.
